Buying off-plan in Abu Dhabi means buying from a developer before completion, with the sale entered in the Interim Real Estate Register; an off-plan sale not registered there is not legally binding. Buyer protections were strengthened by Law No. 2 of 2025, in force from 2 August 2025, and DMT decisions on escrow withdrawals and cancellation refunds. Off-plan deals made up 89% of Abu Dhabi’s residential sales value in H1 2026.

How are off-plan sales registered in Abu Dhabi?

Under Law No. 3 of 2015, which regulates Abu Dhabi’s real estate sector, every off-plan sale must be entered in the Interim Real Estate Register. A sale or other disposal of an off-plan unit that is not registered there is not legally binding. Buyers coming from Dubai sometimes ask for “Oqood”; that is Dubai’s term, and Abu Dhabi does not use it. Registration is the buyer’s core protection. Before paying anything beyond a reservation amount, confirm that the project is registered, that the developer is licensed and that your purchase will be recorded on the interim register through DARI.

How is your money protected when buying off-plan?

Law No. 3 of 2015 regulates developers and escrow, and Law No. 2 of 2025 amended it with effect from 2 August 2025. DMT then issued implementing decisions. Decision No. 24 of 2025 governs escrow withdrawals before a project reaches 20% completion, which must be backed by bank guarantees. Decision No. 165 of 2025 sets out refunds and compensation when an off-plan unit is cancelled and resold. Two further decisions, Nos. 25 and 26 of 2025, cover jointly owned property and standard bylaws for owners’ committees, which shape how a building is run after handover. Together they bring more structure to how off-plan funds are held and how disputes are resolved. Our guide to off-plan payment plans shows what you pay at each stage on the common plan structures.

How big is the off-plan market in Abu Dhabi?

Large and growing. Off-plan deals accounted for 89% of residential sales value in H1 2026, according to ADREC figures reported in September 2026. The top area for residential sales in H1 2026 was Hudayriyat Island, at AED 19bn, where stock is mainly off-plan villas and plots. Like every property advert in the emirate, off-plan marketing needs a Madhmoun permit; for off-plan projects the fee is AED 25,000 per project per broker, for three months. Checking that a project’s listings carry a permit is a simple first test that it is being advertised legitimately.

Does off-plan property qualify for a Golden Visa in Abu Dhabi?

Yes, once enough has been paid. The Abu Dhabi Residents Office accepts off-plan property where the buyer holds a purchase agreement with an approved developer and can show that at least AED 2,000,000 has already been paid to the developer. The visa is valid for 10 years according to ADRO and covers the spouse and children. The contract price alone does not qualify. On a payment plan, eligibility begins when cumulative payments reach AED 2,000,000, so buyers who want the visa early should look at how quickly each plan reaches that milestone.

What should you check before buying off-plan in Abu Dhabi?

Start with the developer: licensing, track record on delivery and the quality of completed projects. Then the project: registration, the escrow arrangements, the construction stage and the realistic handover date. Read the sale and purchase agreement closely for the payment schedule, delay provisions, specification and the treatment of cancellation, which Decision No. 165 of 2025 now addresses. Check the tenure of the specific unit on DARI, because investment-zone status does not guarantee freehold for every plot. Finally, look at how much other supply is due in the same district at the same time, since a crowded handover period can weigh on rents and resale prices. If you are still deciding, our ready vs off-plan comparison sets the two side by side, and if you may want to exit before completion, read selling off-plan before handover.

How ODZ helps buyers assess off-plan opportunities

Off-plan can offer attractive entry points and payment plans, but the buyer carries delivery and market risk for several years. ODZ assesses each opportunity on the developer, the project and the district, and compares the price against existing stock and competing launches. We review payment plans against your objectives, including the AED 2,000,000 Golden Visa milestone where relevant, check registration and tenure details, and stay involved through to handover.
