BUYER & SELLER GUIDES

How to Sell Property in Abu Dhabi While Living Abroad

You can sell property in Abu Dhabi while living abroad by appointing a licensed broker, signing the sale through DARI and, if you cannot attend, authorising a representative with a property-specific power of attorney that has been notarised, legalised by the UAE embassy and attested by the UAE Ministry of Foreign Affairs. Individuals pay no UAE tax on the gain under Cabinet Decision No. 49 of 2023, although your home country may tax it.

Can you sell property in Abu Dhabi without being in the UAE?

Yes. Much of the process runs through DARI, ADREC’s digital platform, and the steps that need a signature in person can be handled by a representative holding a power of attorney. Overseas owners typically appoint a licensed broker to market the property and a trusted representative to sign on their behalf. What remote sellers lose is the ability to react quickly. Buyers’ questions, bank requirements and clearance letters all need prompt answers, so preparing documents early and choosing who will act for you on the ground matter more than they would for a local seller. What are the steps to sell a property in Abu Dhabi?

1. Get a Madhmoun advertising permit through DARI. It needs your consent as owner and a title-deed check, and a broker or the owner can apply. Sales permits cost AED 125–250 plus VAT, and each unit can be marketed by no more than three brokers, or by one exclusive broker.

2. Agree terms and sign the sale and purchase agreement on DARI, which records the property, payment method (cash or mortgage), the parties and any power of attorney, and takes the supporting documents.

3. Clear any mortgage. Obtain a liability or clearance letter from your bank and arrange the mortgage release for the transfer.

4. Get clearances: a developer NOC for off-plan or developer-managed units confirming no dues are outstanding, plus service-charge and utility clearances where required.

5. Register the transfer through DARI and ADREC. ADREC issues the buyer’s new title deed, usually within three days according to Bayut.

What documents do you need to sell property in Abu Dhabi?

Typical documents are the sale and purchase agreement, the original title deed, the parties’ passports or Emirates IDs, the developer and/or bank NOC, a mortgage release letter if there is a mortgage, a site plan issued in the last six months, utility and meter clearances, and a power of attorney if a representative signs. For an overseas seller, the site plan and clearances are the items most likely to cause delay, because they are time-sensitive and depend on third parties. Requesting them as soon as an offer looks likely, rather than after the agreement is signed, keeps the timeline under control.

How do you give power of attorney to sell property in Abu Dhabi?

A power of attorney signed outside the UAE must be notarised in the country where it is issued, then legalised by the UAE embassy or consulate in that country, then attested by the UAE Ministry of Foreign Affairs once it arrives in the UAE. The original must be presented. It should be a special, property-specific power of attorney rather than a general one. It should name the property, the representative and the acts they may perform, such as signing the sale agreement, receiving payment and completing the transfer. Ask the registration authority or your adviser to review the wording before you sign, as a rejected document can cost weeks. Our power of attorney guide covers fees, wording and the ADJD route.

Is selling on Al Reem or Al Maryah Island different?

Yes. Al Reem Island has been part of Abu Dhabi Global Market’s jurisdiction since 24 April 2023, and Al Maryah Island is ADGM’s home. Property there is registered with the ADGM Registration Authority, not ADREC, so the transfer follows ADGM’s process. Marketing is regulated as well. Since 21 August 2025, adverts within ADGM require an ADGM advertising permit issued through its AccessRP platform, which is integrated with Madhmoun. Confirm the documents and fees with ADGM early, particularly if a power of attorney is involved.

Do you pay tax when you sell property in Abu Dhabi?

Not as an individual, in the UAE. There is no personal income tax and no capital gains tax on individuals. Under Cabinet Decision No. 49 of 2023, in effect from 1 June 2023, real estate investment income of a natural person, resident or not, is not a business activity for UAE corporate tax. That covers selling property held personally without a licence, so the UAE tax on the gain is 0%. Two caveats. Property held through a company, or real estate activity that needs a licence, can fall under the 9% corporate tax. And your home country may tax the gain, so take advice where you are tax resident before you sell.

Frequently asked questions

Can I sell my Abu Dhabi property while living abroad?

Yes. A licensed broker can market the property with a Madhmoun permit, the sale agreement is processed on DARI, and a representative can sign for you under a special power of attorney. A POA signed abroad must be notarised locally, legalised by the UAE embassy or consulate and attested by the UAE Ministry of Foreign Affairs.

Is there capital gains tax on selling property in Abu Dhabi?

Not for individuals. The UAE has no personal income tax or capital gains tax on individuals, and Cabinet Decision No. 49 of 2023 treats an individual’s real estate investment income as outside corporate tax. Property held through a company can fall under the 9% corporate tax, and your home country may tax the gain.

What is a Madhmoun permit?

Madhmoun is ADREC’s listing and advertising-permit system. Since 7 July 2025, every property advert in Abu Dhabi needs a prior Madhmoun permit, obtained through DARI with the owner’s consent and a title-deed check. Sales permits cost AED 125–250 plus VAT, and no more than three brokers can market a unit.

How long does a property transfer take in Abu Dhabi?

Once the sale agreement is signed and clearances are in hand, registration through DARI is quick: Bayut reports that ADREC usually issues the new title deed within three days. The longer part is usually before that, gathering the mortgage release, developer NOC, utility clearances and, for overseas sellers, a fully legalised power of attorney.

How do I sell a mortgaged property in Abu Dhabi?

Ask your bank for a liability or clearance letter showing the amount needed to settle the loan. The outstanding balance is settled as part of the sale, and the bank issues a mortgage release so the transfer can be registered. Build the bank’s timeline into the sale agreement, as release letters can take time.
